Introduction & Scope of These Terms
These terms and conditions (“Terms”) apply to your use of the Road2Asia (Pty) Ltd (“Road2Asia”, “we”, “us” and “our”) website and any visa consulting services we provide. Road2Asia operates as a private visa consulting firm (registration number 2023/749662/07) from Waterkloof Ridge, Pretoria, South Africa. Our business assists clients in applying for visas and immigration‑related documentation, but we are not a government department, embassy or issuing authority. By accessing our website or engaging our services you agree to these Terms. The Immigration Act 13 of 2002 regulates the admission of persons to, their residence in, and their departure from South Africa ; Road2Asia conducts its business in accordance with that law.
Key Terms & Interpretations
For clarity in these Terms, the following definitions apply:
- Client refers to any person or entity that uses Road2Asia’s website or requests our visa consulting services.
- Services means the visa consulting, advisory and document‑submission services offered by Road2Asia, including but not limited to providing guidance on visa requirements, compiling and submitting visa applications on a client’s behalf and liaising with government departments or consulates.
- Electronic Communications and Transactions Act (ECT Act) refers to the South African Electronic Communications and Transactions Act, 25 of 2002. Section 21 of the ECT Act recognises electronic communications as valid and binding.
- Force Majeure means circumstances beyond a party’s reasonable control (such as natural disasters, war, riots or strikes) that prevent that party from fulfilling its obligations.
Effective Date and Termination
These Terms become effective when the Client first accesses Road2Asia’s website or engages our Services. They remain in force until amended or terminated in accordance with the procedures below. Either party may terminate the relationship by giving written notice; however, any obligations incurred (such as payment for Services already rendered) will remain enforceable. Road2Asia may update these Terms from time to time. The updated version will be posted on our website and will supersede previous versions. Continued use of the Services after changes constitutes acceptance of the updated Terms.
Electronic Communications Agreement (ECT Act Section 21)
Under Section 21 of the ECT Act, electronic communications (including email, website forms and messaging applications) between Road2Asia and the Client are legally binding. By using our website or Services, the Client agrees to the following communications terms:
- The agreement between Road2Asia and the Client is concluded in Pretoria, South Africa when the Client accesses our website or requests our Services.
- Data messages sent by the Client to Road2Asia will only be deemed received when Road2Asia responds.
- Electronic signatures, encryption or authentication are not required for communications between Road2Asia and the Client to be valid.
- Emails or messages sent from a computer or device ordinarily used by the Client are presumed to be sent or authorised by the Client.
- Emails sent by Road2Asia are deemed received when the Client can download them.
Use of Road2Asia’s Visa Consulting Services
Road2Asia provides visa consulting and documentation assistance. Our role is to guide clients through visa requirements, collect and submit applications and liaise with authorities. We do not issue visas or grant immigration status; final decisions rest with the relevant government or consular authority. By using our Services, you acknowledge and agree that:
- Non‑government status: Road2Asia is a private company and not a government department or embassy. We provide advice and assistance but do not have authority to approve or reject visa applications.
- Scope of services: We assist in completing application forms, compiling supporting documents and submitting them to the appropriate authorities. We may engage third‑party couriers or service providers to deliver documents.
- Professional fees: Our fees cover our expertise, time and effort. They do not include government visa fees or courier costs unless explicitly stated. Fees are payable in advance and are non‑refundable except as provided under the “Document Errors & Availability” clause below.
- No guarantee of approval: Road2Asia does not guarantee that a visa or permit will be granted. Approval is subject to the discretion of the relevant immigration authority, and timelines may vary.
Client Document Submissions
To perform our Services efficiently, Road2Asia requires accurate and complete documentation from the Client. The Client is responsible for ensuring that all documents provided are genuine, up‑to‑date and correctly certified where necessary. The following conditions apply:
- Secure delivery: All physical documents sent to Road2Asia must be dispatched via a reputable courier with tracking. We recommend using reliable couriers; we are not responsible for losses or delays caused by postal or courier services.
- Packaging: Documents should be securely packaged to prevent damage during transit. Unless previously agreed, only original documents (not laminated or certified copies) should be provided.
- Client responsibility: Clients must determine which documents are needed for their visa application. While we offer guidance, we do not accept liability for incorrect or missing documentation.
Projected Processing Times
Based on our experience with various embassies and government departments, Road2Asia may provide estimated timelines for visa processing. These estimates are guidelines only and are not binding. Government departments, embassies and other third parties control processing times; therefore:
- Road2Asia will not be liable for delays beyond our control. All time frames refer to business days and does not include non-business days.
- If processing takes longer than the estimated timeframe, we will inform the Client but cannot refund fees or accept liability for resulting losses.
Document Errors & Availability
Errors or omissions in documents issued by government departments can delay visa applications. Road2Asia will attempt to assist in correcting minor errors where possible; however:
- We are not liable for mistakes or inaccuracies in documents issued by third parties.
- If a government department refuses to issue a required document or if the document is unavailable, Road2Asia will not refund the fee allocated to obtaining that document due to administration fees.
- Road2Asia is not responsible for any losses the Client incurs due to the unavailability of a document.
Liability Limitations & Disclaimers
To the fullest extent permitted by law:
- Road2Asia is not liable for any non‑delivery or delayed delivery of Services caused by factors outside our reasonable control. Examples include, but are not limited to, natural disasters, war, fire, floods, strikes, government delays or third‑party errors.
- In the event of a Force Majeure event lasting more than 90 days, either party may terminate its obligations by giving written notice; no damages or losses may be claimed.
- Road2Asia is not responsible for damage, injury, loss or consequential damages arising from the use of our Services or those of third parties.
- Our liability to any Client, whether in contract, or otherwise, will be limited to the amount of fees actually paid by the Client for the Services in question.
Entire Agreement & Severability
These Terms constitute the entire agreement between Road2Asia and the Client with respect to the Services and supersede all prior agreements or representations. Any amendment or waiver must be in writing and signed by an authorised representative of Road2Asia. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. Failure by Road2Asia to enforce any provision does not waive our right to enforce it later.
Applicable Law & Jurisdiction
These Terms and any disputes arising from them are governed by the laws of South Africa. The parties consent to the jurisdiction of the South African courts. Road2Asia operates within the framework of the South African Immigration Act, which provides for the regulation of admission, residence and departure of persons from the Republic.
General Provisions
- Good faith: Road2Asia and the Client undertake to act honestly and in good faith toward one another at all times.
- Legal advice: Each party acknowledges that they had the opportunity to seek independent legal advice about these Terms and either did so or chose not to.
- Consent to jurisdiction: The parties agree to the jurisdiction of the Magistrates’ Court as outlined in Section 45 of the Magistrates’ Courts Act 32 of 1944 for any legal proceedings related to these Terms.
